Terms of Service

1 Acceptance of Terms

By accessing, registering for, and using the services provided by VisiHost ("we," "us," or "our"), you ("Customer," "User," or "you") agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you may not use our services.

These terms apply to all services provided by VisiHost, including but not limited to Minecraft Hosting, Discord Bot Hosting, Voice Server Hosting, and any future hosting services.

2 Eligibility & Account Registration

2.1 Eligibility

You must be at least 13 years of age to use our services. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian who agrees to be bound by these terms.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized use of your account. VisiHost is not liable for any loss or damage arising from your failure to protect your login information.

3 Orders & Service Provisioning

Services are provisioned automatically upon successful payment processing in most cases. However, certain services or circumstances may require manual review to prevent fraud. We reserve the right to refuse service, cancel orders, or request additional verification before activating a service.

4 Billing & Payments

All services are billed on a prepaid basis according to the billing cycle you select during checkout. You agree to provide accurate and updated payment information.

• All prices are subject to change with a minimum of 14 days' notice to active customers.
• Refunds are governed entirely by our Refund Policy.
• Any chargebacks or payment disputes initiated without first contacting our support team may result in immediate and permanent termination of all your services without a refund.

5 Renewals & Suspensions

Invoices for service renewal are generated prior to your service due date. If an invoice remains unpaid after the due date, your service will be automatically suspended. Suspended services may be permanently terminated and data deleted if payment is not received within our grace period (typically 7 days, unless otherwise specified).

6 Acceptable Use Policy (AUP)

You agree to use VisiHost services solely for lawful purposes. You are strictly responsible for all activity originating from your servers. We enforce a zero-tolerance policy for network abuse.

7 Prohibited Activities

The following activities are strictly prohibited and will result in immediate suspension or termination without refund:

• Hosting or distributing malware, viruses, or destructive code.
• Engaging in phishing, spamming, or sending unsolicited communications.
• Executing or participating in Denial of Service (DDoS) attacks.
• Hosting illegal content, including material that violates copyright laws or intellectual property rights.
• Cryptocurrency mining (e.g., Bitcoin, Ethereum, Monero).
• Server exploitation, reverse engineering of our infrastructure, or unauthorized access attempts.
• Automated abuse, scraping, or botnet command and control (C2).
• Hosting services designed to interfere with other networks or users.

8 Fair Resource Usage

Unless specifically advertised as "dedicated," our hosting services operate on shared hardware. Customers may not monopolize system resources (CPU, RAM, Disk I/O, Network Bandwidth) in a manner that negatively impacts other users on the same node.

We reserve the right to throttle, suspend, or request an upgrade for services consistently utilizing excessive resources beyond their allocated or reasonable limits.

9 Maintenance, Downtime & Backups

9.1 Maintenance

We occasionally perform routine and emergency maintenance to ensure optimal performance and security. We will make reasonable efforts to notify you in advance of scheduled maintenance, but emergency maintenance may occur without notice.

9.2 Backups

While we may provide backup tools or automated backups for certain services, you are solely responsible for maintaining off-site backups of your data. VisiHost is not liable for any data loss, corruption, or hardware failure.

10 Limitation of Liability & Warranties

Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. VisiHost disclaims all warranties, including merchantability or fitness for a particular purpose.

In no event shall VisiHost be liable for any indirect, incidental, special, or consequential damages, including loss of profits, revenue, data, or use, incurred by you or any third party.

You agree to indemnify and hold VisiHost harmless from any claims, damages, or liabilities arising out of your use of our services or violation of these terms.

11 Termination of Services

You may cancel your services at any time through the client area. Cancellation requests must be submitted before the generation of the next invoice to avoid further charges.

We reserve the right to terminate or suspend your access to our services at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties.

12 Governing Law & Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in India.

Neither party shall be held liable for any failure to perform its obligations under these terms due to circumstances beyond its reasonable control (Force Majeure), such as natural disasters, governmental actions, or widespread network outages.

We reserve the right to modify these Terms of Service at any time. Continued use of our services after any such changes constitutes your consent to such changes.
